Preamble and Introduction

Welcome to OpenNE and Services!

To use the OpenNE academic software (collectively referred to as the Software) and related services, you must read and comply with the OpenNE License and Service Agreement (hereinafter referred to as this Agreement), as well as the AegeanSoft Privacy Policy.

Please carefully review and fully understand all terms, especially those regarding:

  • Exemption or limitation of AegeanSoft’s liability
  • Restrictions on users’ rights
  • Dispute resolution mechanisms and jurisdiction clauses
  • Separate agreements for activating or using specific services

Limitation-of-liability clauses, disclaimers, or other terms affecting your significant rights may be highlighted in bold, underlined, or other formats for emphasis.

If you lack full civil capacity due to age, intellectual ability, or other factors, please review this Agreement and decide whether to accept its terms under the guidance of your legal guardian (hereinafter referred to as Guardian).

If you are located outside the Chinese Mainland, your execution of this Agreement and use of the services must also comply with the laws of your country or region of residence.

Definitions:

  • AegeanSoft: Refers to AegeanSoft Corporation and its affiliated operating entities potentially involved in providing relevant services.
  • OpenNE User: An individual that registers for, logs into, or uses OpenNE software/services with administrative privileges.

The aforementioned OpenNE User and End User are collectively known as Users or All Users, and are referred to throughout this Agreement as You.


1. Scope of Agreement

1.1 Agreement Governing Clauses

This Agreement constitutes a contract between you and AegeanSoft Corporation regarding your downloading, installation, usage, logging into the Software, and utilization of the Services.

1.2 Composition of Agreement

The content of this Agreement includes, but is not limited to, the following agreements, rules, and specifications related to the Software and/or Services, as well as any relevant documents that AegeanSoft may periodically publish concerning the Software and/or Services:

  • Upon official publication, the aforementioned materials shall become an integral part of this Agreement;
  • They shall form a unified whole with this Agreement, which you are equally bound to observe the AegeanSoft Privacy Policy.

2. About the Software and Services

2.1 Definition of the Software

The Software refers to the OpenNE developed by AegeanSoft Corporation, which is licensed to users for downloading, installation, and use pursuant to the terms of this Agreement and other agreements and rules set forth by AegeanSoft.

2.2 Service Modification Clause

You acknowledge and agree that AegeanSoft may update or adjust the content of the Services as necessary.

2.3 Usage Requirements

You may access the Services through terminals (e.g., computers, mobile devices) via clients or web interfaces, as specified by AegeanSoft.

AegeanSoft reserves the right to expand available terminals and access methods.

To ensure proper functionality, you must select a Software version compatible with your terminal and operating system. Otherwise, service accessibility may be impaired.

2.4 Licensing Terms

AegeanSoft grants you a non-transferable and non-exclusive license to use the Software within the scope and manner limited by this Agreement and other agreements and rules of AegeanSoft.

2.4.1 You may download, install, use, and log into the Software on a single terminal device for non-commercial purposes.

2.4.2 All rights not expressly granted herein remain reserved by AegeanSoft. Exercise of such rights requires separate written permission from AegeanSoft. AegeanSoft’s failure to enforce any right shall not constitute a waiver thereof.

2.5 Service Adjustment Policy

AegeanSoft may modify pricing structures and methods for paid Services.

Additionally, AegeanSoft reserves the right to convert select free services to paid offerings. Prior notice will be provided on relevant service pages before implementing such changes.

If you disagree with modifications or new charges, you may discontinue using the affected Services.

3. Software Acquisition

3.1 Authorized Channels

You may obtain the Software exclusively through AegeanSoft’s official channels, including:

  • Official AegeanSoft website
  • Official application distribution platforms
  • Third-party websites or app distribution platforms expressly authorized by AegeanSoft

3.2 Risks of Unauthorized Acquisition

If you acquire the Software or an installation package bearing identical nomenclature from unauthorized third parties:

  • AegeanSoft cannot guarantee normal functionality of such software;
  • AegeanSoft shall bear no responsibility for any damages incurred thereby.

4. Software Installation and Uninstallation

4.1 Version Selection

AegeanSoft may develop distinct Software versions for different terminals and operating systems. You must select the appropriate version according to your specific configuration.

4.2 Installation Procedure

After downloading the installer, follow the on-screen prompts to complete proper installation.

4.3 Optional Additional Software

To enhance service quality and security, AegeanSoft may recommend supplementary software during installation. You may choose to install or decline such additions.

4.4 Regional Service Variations

Service availability may differ across regions due to business strategy adjustments. Actual service offerings are subject to AegeanSoft’s operational provisions.

4.5 Uninstallation Process

You may uninstall the Software when no longer needed or before installing a new version. If you are willing to help AegeanSoft improve its products, please share your reasons for uninstallation.

5. Software Updates

5.1 Purpose of Updates

To enhance user experience and improve service offerings, AegeanSoft may continuously develop new services and periodically provide Software updates.

5.2 Update Rights

AegeanSoft reserves the right to:

  • Update the Software;
  • Modify specific functionality;

for purposes including:

  • User experience optimization
  • Service security enhancement
  • Functional consistency assurance

5.3 Version Compatibility Notice

Following new Software version releases:

  • Previous versions may become inoperable;
  • AegeanSoft does not guarantee continued usability of legacy versions;
  • Maintenance/support for legacy versions will cease;
  • Always verify and install the latest version.

6. User Information and Personal Data Protection

6.1 Data Protection Principles

Protecting user information constitutes a fundamental principle for AegeanSoft. Within legal boundaries, AegeanSoft shall collect, use, store, and share your relevant information in accordance with this Agreement and the AegeanSoft Privacy Policy, primarily covering:

6.1.1 Device Specifications Include:

  • Audio/video hardware capabilities;
  • Operating system version identification;
  • Network addressing parameters;
  • Primary storage allocation status.

6.1.2 Diagnostic Logs Comprise:

  • Network endpoint identifiers;
  • System error diagnostics;
  • Application operation audit trails.

6.1.3 Network Performance Metrics Consist Of

  • Data transmission loss rate;
  • Signal propagation latency measurements.

6.2 Information Submission Requirements

During account registration or service activation, you must provide necessary information. Where national laws and regulations (hereinafter Laws refer to currently effective statutes, administrative regulations, judicial interpretations, local regulations, departmental rules, and normative documents in your jurisdiction, including subsequent amendments) mandate:

  • You must submit authentic identification details (e.g., mobile number);
  • Incomplete or false submissions may restrict or prevent service access.

6.3 Data Modification Rights

Generally, you may review and modify submitted information per product rules. As an End User:

  • Initial registration data and verification details remain unmodifiable for:
    • Security protocols
    • Identity authentication (e.g., account recovery)

6.4 Security Infrastructure Development

  • Formalized cybersecurity policy documentation;
  • Operational protocols addressing:
    • Privileged access delegation procedures;
    • Role-based permission architecture;
    • Credential protection countermeasures.

6.5 Technical Safeguards

AegeanSoft implements:

  • Advanced security technologies;
  • Comprehensive management systems;

to prevent unauthorized access, use, or disclosure of your personal data.

6.6 Information Sharing Restrictions

AegeanSoft strictly limits data sharing per applicable Laws, rigorously adhering to:

7. User Conduct Guidelines

7.1 Registration and Account Usage

You fully understand and agree:

7.1.1 Users shall provide accurate and updated information per applicable laws and service requirements. Prohibited actions include:

  • Impersonating others during registration;
  • Registering accounts for others without authorization;
  • Registering in misleading manners;
  • Using usernames infringing third-party rights;
  • Malicious bulk account registration.

7.1.2 Individual Users must possess full civil capacity when registering or using the Service. Otherwise:

  • Explicit consent of the guardian shall be obtained prior to registration;
  • Ineligible users shall not use the Service, and the user and their guardian shall bear all consequent liabilities;
  • Aegean reserves the right to cancel, temporarily or permanently freeze the account;
  • Aegean may claim compensation for any losses against the user and their guardian.

7.2 User Obligations

You fully understand and agree:

7.2.1 AegeanSoft collects information under the lawful, necessary, and legitimate principle for service enhancement and security maintenance.

7.2.2 You may be required to accept separate agreements and rules when using specific functions. Please read such terms carefully before use.

7.2.3 You may decline to provide certain information or disable data collection via product settings, which may cause partial service functions to be unavailable.

7.2.4 While AegeanSoft adopts commercially reasonable security measures to protect your data, absolute data security is not guaranteed:

  • AegeanSoft shall not be liable for data deletion or storage failure caused by non-AegeanSoft reasons;
  • Users shall independently back up all data stored in the service, unless otherwise agreed by both parties;
  • If your service is terminated due to your violation of laws or this Agreement, AegeanSoft may permanently delete your data with no obligation of data return; you shall complete backup in advance.

7.3 Prohibited Conduct

You shall not engage in or facilitate:

7.3.1 Illegal Content:

  • Subverting constitutional principles;
  • Endangering national security/unity;
  • Damaging national honor/interests;
  • Inciting ethnic hatred/discrimination;
  • Promoting cults/superstition;
  • Spreading rumors disrupting social order;
  • Distributing obscene/violent content;
  • Infringing others’ legitimate rights;
  • Violating China’s Seven Baselines;
  • Other unlawful actions.

7.3.2 Software Restrictions:

  • Removing copyright information;
  • Reverse engineering/decompiling;
  • Unauthorized use of intellectual property;
  • Creating derivative works without authorization;
  • Employing unauthorized third-party tools;
  • Interfering with software operations.

7.3.3 Platform Security Violations:

  • Disseminating fraudulent information;
  • Spreading malware/virus creation tools;
  • Compromising system security.

7.4 Legal Accountability

You understand and agree:

7.4.1 Violations authorize AegeanSoft to:

  • Issue warnings;
  • Restrict service functionality;
  • Delete content/disable links;
  • Suspend/terminate accounts;
  • Adopt other reasonable and legitimate measures;
  • Pursue legal remedies.

7.4.2 If you violate laws, regulations, this Agreement, and/or other agreements or rules of AegeanSoft, and AegeanSoft takes any actions or measures against you or the Software and/or Service used by you—resulting in temporary or permanent inability to use OpenNE, inability to log in to OpenNE, or inability to access other products and/or services—you shall solely bear the corresponding consequences. Any losses incurred as a result shall be borne exclusively by you.

7.4.3 You shall independently adopt reasonable and secure backup measures outside the Service for any data generated through or stored within the Service due to your usage. Should AegeanSoft implement permanent account suspension or other measures against you under this Agreement, AegeanSoft reserves the right to permanently delete all service-related data or all information stored by you within the Service. You shall bear full responsibility for any consequences arising therefrom.

7.4.4 If you cause any harm to a third party, you shall bear sole responsibility for such harm. If AegeanSoft suffers losses as a result, you shall also compensate AegeanSoft accordingly.

7.5 Behavioral Responsibility

You acknowledge sole responsibility for:

  • You must bear full responsibility for all actions taken in your use of the Software and/or the Service, including any content you publish and any consequences arising therefrom;
  • You shall exercise your own judgment regarding the content encountered through your use of the Software and/or the Service, including the risks arising from reliance on its accuracy, completeness, or usefulness. You shall bear all corresponding risks caused thereby, and AegeanSoft shall not be liable for any loss or damage incurred by you due to such risks within the scope permitted by law;
  • If you are an institutional user, you shall be responsible for the conduct of the administrator account(s) designated by you. Additionally, you shall bear the consequences of any service adjustments implemented by AegeanSoft based on the actions, operations, or instructions of such administrator account(s);
  • If you are a natural person lacking full capacity for civil conduct, you should understand that your guardian will be fully responsible for all actions you take while using this Service.

7.6 Content Management & Reporting

7.6.1 If the content you send or disseminate violates laws or regulations or infringes upon the rights of others, you agree that AegeanSoft has the right to independently determine whether to take measures such as deletion, blocking, or disconnecting links.

7.6.2 If you are subject to a complaint by others or if you file a complaint against others, AegeanSoft retains the right to provide necessary information—including the identities, contact details, and relevant content of the complaint concerning involved parties in the dispute—to the relevant parties or authorities. This is done to facilitate timely resolution of complaint disputes and protect the legitimate rights and interests of all parties involved.

8. Third-Party Products or Services

8.1 Usage of Third-Party Services

When using third-party products or services on AegeanSoft platforms:

  • Compliance with this Agreement is required;
  • The third-party’s user agreements must be observed;
  • Prior review of their terms and privacy policies is recommended;
  • AegeanSoft and third parties bear respective liabilities for disputes as legally prescribed.

8.2 Integration of Third-Party Systems

When OpenNE interfaces with third-party systems per user requirements:

  • Such integrations may involve external system calls;
  • Service outcomes remain third-party responsibilities;
  • AegeanSoft disclaims liability for third-party service performance.

9. Advertising

9.1 Advertising Display Rights

You acknowledge that AegeanSoft may, independently or through third parties:

  • Deliver commercial and non-commercial communications via SMS, email, or other channels;
  • Determine advertising formats at AegeanSoft’s sole discretion;

9.2 Advertising Accountability

You expressly agree:

  • AegeanSoft conducts advertising activities in compliance with applicable laws;
  • You must exercise due diligence in verifying advertisement authenticity;
  • Except where legally mandated, you bear sole responsibility for actions taken based on advertisements.

10. Intellectual Property

10.1 Ownership of Intellectual Property

AegeanSoft is the intellectual property rights holder of the Software:

  • Software copyrights, trademarks and related rights are protected under applicable laws;
  • Information content (text/images/audio-video materials, etc.) is protected by international treaties;
  • AegeanSoft lawfully enjoys relevant intellectual property rights, except where statutory rights belong to other parties.

10.2 Intellectual Property Restrictions

Without prior written consent from AegeanSoft or relevant rights holders:

  • You shall not exploit the aforementioned intellectual property rights;
  • Nor permit any third party to utilize or transfer such rights, whether for commercial or non-commercial purposes.

11. Terminal Security Responsibility

11.1 Security Risk Advisory

You understand and agree that the Software and/or Services, like most internet-based offerings:

  • May be affected by multiple factors (user actions/network quality/social environment, etc.);
  • May encounter security risks (e.g., unauthorized use of user data; malware-infected downloads).

You therefore commit to:

  • Enhancing information security awareness;
  • Implementing robust password protection to prevent losses.

11.2 Prohibited Activities

You shall not create, publish, utilize, or disseminate:

  • Malicious programs designed to steal OpenNE account credentials;
  • Malicious programs intended for property theft.

11.3 Shared Responsibility

Maintaining software security constitutes a mutual obligation:

  • AegeanSoft will implement industry-standard technical measures;
  • You acknowledge AegeanSoft provides no absolute security guarantees.

12. Third-Party Software or Technology

12.1 Usage Authorization

The Software may utilize:

  • Third-party software/technology (including open-source and public domain code);
  • Such usage carries valid legal authorization.

12.2 License Documentation

When third-party components are incorporated:

  • AegeanSoft will display relevant agreements through:
    • Agreement appendices;
    • Installation package directories;
  • Expressed as Software License Agreements or Open-Source Licenses etc.

12.3 Legal Validity

Such agreements constitute:

  • An integral part of this Agreement;
  • Equally legally binding instruments.

You must comply with these requirements. Consequences of Violation:

  • Third parties or government authorities may initiate:
    • Litigation;
    • Administrative penalties;
  • AegeanSoft may be compelled to provide assistance;
  • You assume full legal responsibility.

13. Force Majeure and Other Disclaimers

13.1 Force Majeure Clause

You understand and agree that during service usage:

  • Force majeure events may occur;
  • Force majeure denotes unforeseeable, unavoidable, and insurmountable events including:
    • Natural disasters (floods, earthquakes, epidemics, etc.);
    • Social incidents (war, riots, government actions, etc.).

13.2 Service Interruption Exclusions

Within legal boundaries, AegeanSoft assumes no responsibility for interruptions caused by:

  • Computer viruses, malware, or hacker attacks;
  • Failures in user/AegeanSoft software, systems, hardware, or communication lines;
  • Improper operation or unauthorized service access;
  • Obsolete software, device incompatibility, or aging hardware;
  • Other uncontrollable or unforeseeable circumstances.

13.3 Network Risk Disclaimer

You acknowledge that service usage involves:

  • Risks from online information and user behavior;
  • AegeanSoft assumes no liability for:
    • Information authenticity, applicability, or legality;
    • Damages from infringing activities.

13.4 Illegal Content Handling

Under this Agreement:

  • AegeanSoft reserves the right to process illegal content;
  • This right constitutes neither an obligation nor guarantee;
  • Timely detection or processing is not assured.

13.5 Property Security Advisory

At all times:

  • Exercise extreme caution regarding financial requests (e.g., loans, password solicitation);
  • Verify counterparty identity before property-related actions;
  • Regularly review AegeanSoft’s anti-fraud notifications.

14. Miscellaneous

14.1 Agreement Acceptance and Modification

By using the Software and/or Services:

  • You acknowledge having read and accepted this Agreement;
  • AegeanSoft reserves the right to modify terms when necessary;
  • Updated versions will be accessible through service interfaces;
  • Continued usage constitutes acceptance of amended terms.

14.2 Place of Execution

This Agreement is executed at Chaoyang District, Beijing, People’s Republic of China.

14.3 Governing Law

The formation, validity, performance, interpretation:

  • And dispute resolution hereunder;
  • Shall be governed by the laws of Mainland China;
  • Excluding conflict of law principles.

14.4 Dispute Resolution

For any controversy or claim:

  • Parties shall first attempt amicable negotiation;
  • Failing resolution, disputes shall be submitted to:
    • The competent People’s Court;
    • In Chaoyang District, Beijing (place of execution).

14.5 Heading Interpretation

The headings of all clauses in this Agreement are included solely for reading convenience. They are void of substantive meaning and shall not be used as a basis for interpreting the provisions of this Agreement.

14.6 Severability

If any provision of this Agreement is held to be invalid or unenforceable for any reason whatsoever, the remaining provisions shall continue in full force and effect and be binding upon both parties.

14.7 Language Versions

In the event of any discrepancy between the Chinese version of this Agreement and its translations in other languages such as English, the Chinese version shall prevail.
